I was trying to see under what basis he could have brought the firearm legally, and I can’t find any. Aside from the fact that he’s underage, Illinois and Wisconsin do have reciprocity laws, but Illinois does not recognize the Utah Permit so that is out. And he can’t get a firearm in Illinois under 18 either. As far as I know, there is no federal law prohibiting interstate transit of firearms; it’s all at the state-level. But I think they can get him on 1st degree murder charges regardless. That drive to Kenosha is long enough to seriously reconsider what he was doing at some point.

Him open carrying it was illegal. The gun itself wasnt illegal, modified machine gun, shortened barrel ect. Not sure about that state's law but federal law allows minors to posses long guns, say gifted them, but can't buy them. Him possessing it was likely not illegal (though the civil suits against the people that gave it to him will fly). While breaking the law by open carrying it isnt going to help his defense, illegal possession of a gun doesnt negate his right to self defense. Felons prohibited from owning and possessing guns dont lose their right to use a gun in self defense if their life is in danger. Non felons who say carry concealed without a license or in areas where it's illegal are the same. All comes down to who started and escalated the first incident where he started firing. If he did it on his lonesome he should rightfully go down for it. If the first guy that got it in the head legitimately give him legal reason to fear for his life I think a whole lot of people who have a notion he's guilty no matter what are going to be in for a big surprise. Him showing up looking for trouble is the main thing against him and I dont think he's likely to overcome that with a jury if it gets there. Why they went for 1st degree pretty fast. Usually it means the feds get a crack at him, or it triggers some "you definitely sex-trafficked a minor" statute. In this case I doubt it'll matter because all the real crimes are in Wisconsin's jurisdiction and the idea that the Trump administration would prosecute a newly minted hero of the right is laughable anyway.

In Wisconsin, persons under 18 are prohibited from owning dangerous weapons unless under the direct supervision of an adult during target practice or otherwise engaging in training in the proper and traditional use of said dangerous weapon. Wisconsin defines "dangerous weapons" to include firearms loaded or unloaded, as well as nunchucks, throwing stars, weighted chains, etc. I'd expect that that'll come into play when he starts his mess. And Illinois is the home of the FOID. Persons under 21 aren't eligible on their own, those aged 18-20 need parental consent, from what I've seen. Looking for trouble on top of that, maybe it won't go down as nicely as the gun enthusiasts are hoping.
