That's probably correct. The Supreme Court doesn't want to touch abortion with a 10-foot pole, so they're hoping an appellate court will shoot it down for them. And they probably also don't want to circumvent normal judicial process for something as divisive as this.
I took it to mean that it's not ready for the Supreme Court YET. It needs to go through the appropriate channels first. As far as the ridiculousness of it goes, I was reading about a bunch of hilarious ways this could backfire on the Republicans.
The problem is that the Fifth Circuit has already jumped the track on normal judicial process by canceling a hearing on the issue and allowing the law to go into effect without considering an injunction. If the system were operating properly there would already be an injunction in place and it would be well on its way to being declared unconstitutional at the lower court level.

Who knows? I don’t know how the courts do and don’t decide to put injunctions in place to controversial laws. I’m pretty limited in knowing how that system works, but I don’t see how it doesn’t make its way to the higher courts at some point.
If that’s true, passing the buck is not a good look for people of that position. You’re a country, not fifty little ones. They should be reminding your dumber-run states (Texas and Florida) how laws like Roe v. Wade work. The Supreme Court should be bringing the hammer down, defending THEIR decision, which is law. Otherwise the Supreme Court should take “United” out of the name of your country.

It’s certainly poking the hornets nest like gun owners of yesteryear. Count me as a conservative that thinks it’s a topic that should be let go.
But as Kagan points out, the Court has been using the shadow docket for every little thing they want, so to pretend like they're just oh so restrained by procedure on this issue reads pretty farcical.
So they use it for some things they want and other things they don’t. Like I said, I don’t think they want to go anywhere near abortion either way. I’m not allowed in the SC chambers, so I’m just speculating.
It seems pretty clear that what they want is to overturn Roe v. Wade without the front page of the New York Times being "SCOTUS OVERTURNS ROE V. WADE"
Based on that logic, is it possible that the TX GOP had an "oopsie" when the SC refused to throw it out? This is a messy law, and it's going to get a lot of attention....they are already trolling the hotline to the extent of rendering it useless. I hope it becomes an albatross for the folks responsible for it. I wonder if they miscalculated on this actually holding up in a higher court, and are now forever linked to this monster.
That’s my thought process too. They normally rely on the courts to save them from themselves. I don’t think a lot of them truly expected it to pass. Hence the overall lack of gloating from the politicians on social media they normally would do. I don’t feel they are truly as happy as one would think. When Obama was President but the gop had Congress, they tried to repeal Obamacare almost 70 times knowing it would get vetoed each time thus allowing them to say they tried without having the fallout of truly taking healthcare away from millions. They laid off when they had the White House, and Congress. This law is so messy and leaves open a ton of legal questions about applicability, standing, HIPAA, etc. I feel they should have put a stay on it, but I guess would rather have a real question of constitutionality before they decide.
Roberts doesn't matter anymore. They've got five votes without him, and the lower courts have been designed to drop shit sandwiches in SCOTUS's lap.
Well this is backfiring spectacularly. My in laws are super anti-abortion (no church/state separation) and the idea of basically being able to tattle on each other has pissed them the fuck off. Small sample size I know, and I hate it when people use anecdotal evidence, but this got them real riled up in a way I didn’t think it would.
It goes a little something like this. Now that the dog has finally caught the car, or perhaps the car slowed down to let itself be caught?, that is one evergreen talking point the GOP no longer can bank on. After all, what is actually stopping them from copy/pasting this everywhere they can?
